Brain Injury Litigation in California

In California, litigation must be filed within two years of a personal injury. However in some cases (such as a brain injury occurring from medical malpractice) that term may be extended to three years.

When pursuing a legal claim, the plaintiff must prove the defendant is at fault for resulting brain injury by acting in a negligent manner. For example, an extremely careless driver or a surgeon who operated recklessly may be found at fault for causing an injury.

In California, under the Comparative Fault Standard, victims may also be determined to be partially at fault for their injuries if they are found to have acted with negligence or carelessness. This may impact any judgment for the plaintiff.
